So since I have wrote this, Toyota has got back to me and said they are not going to replace my car, they are going to fix it....for the 13 time. I told them that this was unacceptable, but they don't care.

Yeah, I looked into CAMVAP, that is my last resort as that is arbitration, so once you go through that, the decision is final, there is no recourse. I am actually getting signs printed up right now and this weekend I am going to be picketing in front of the Toyota, I have invited the media (I am sure they are looking for some "filler" for there weekend programming) I am preparred to do this for a couple of months on weekends only for 5 or so hours per day...this is my first step.

I am trying to avoid paying for a lawyer immediately as I do not want to spend anymore money on this Lemon. I am filling out the forms for small claims court and hope to serve them within the next couple of weeks. If this does not work, I will pay for the lawyer. A friend of mine is a lawyer and he says I should have no trouble winning this in small claims.

The reason the other person gave the car back to Toyota with 1,000kms on it was because he did not like driving it in winter...he traded it on a Tundra. I asked the salesman if anything had been repaired on the car and he said no.

In my original post #7, #8 and #9....each time I came in to Toyota with the CEL light on. They tried to capture the code each time and each time they failed. They said they could not get all of the data and asked me to get the light to come on again. I had to get it to come on 4 times for them to look at the issue in detail. #10 I told them I was sitting in a drive-thru idling, I looked down and the light was on.

It is amazing to me that they want to fight me on a car that has 7,000kms on it, I would think they could take this, fix it, sell it and give me a new car. I didn't ask for a buyout, I asked for another FR-S. I gave them EVERY opportunity to make this right without getting lawyers involved, but honestly they could care less about the customer.

....I honestly thought Toyota was better than the rest, but I see they are the same.

That makes no sense. CEL = fault in the ECU and logged until cleared. Either the ECU is actually screwed or the dealer is incompetent.

Mind posting what dealer in Calgary so I know to stay far away from?

On that note too if there's anything you need a hand with from another FR-S owner in Calgary give me a shout anytime (check things on my car, compare, check codes, etc)

Too bad they didn't let you keep the toasted engine block, would've been great to build up over time and swap in to get rid of them working on the car

They said their computers could not capture all of the data, but that it was the Air/Fuel/Camshaft error which is the one that comes on 80% of all the times. They said they were not capturing all of the data and once the light was turned off, they said they needed it to come back on before they could troubleshoot anything.

Yeah, I was super frustrated at this as well...4 times I had to take my car back and drive it around until the CEL came on.

Does the CEL cause limp mode?

If you do get limp mode each time with CEL I would definitely try for the arbitration method. Too bad you aren't US and can't lemon...

That would be fraud on the part of the salesman & dealership. That's something to note if you decide to look into arbitration or a lawsuit.

Personally I'd rather go through arbitration or court rather than spend 5 hrs/weekend picketing the dealership, but that's up to you. You can also try reporting to BBB (or Canadian equivalent). In the US, we also have state attorneys general who would help in these situations. Not sure if there's a Canadian equivalent.

The Dealer is Country Hills Toyota
Try AMVIC as well, not sure if they can help after the fact but maybe can put some pressure on the dealer.

Yes and no.

If the car was sold used with dealer's expressed written warranty, yes.

If the car was sold used "as-is" but with manufacturer's warranty, no (but you can try to fight this with litigation).

And contact southe point and stampede Toyota and see if they'll help you out somehow.

Also if you are financing the car, contact toyota financial and complain directly to them that you shouldn't be paying for a vehicle that is not derivable and repeatedly being repair. I think I remember someone posting that they got a credit while getting their engine fixed

Yes if it comes from a dealer with an implied warranty/clean bill of health there are legal protections but they vary by state and can be very limited: (Note OP is in Canada so his protections are different)

Further adding complication, from the OP's story it may not have been sold as a used car, or I may be confusing stories that the salesman implied it was 'new' at the time of purchase, might be some gray area there in favor of the OP.

In any case, this thread would not exist if the OP was compensated and treated well from the get go. Not being able to pull the codes reeks of incompetence or laziness, Toyota has been screwing the pooch on this one.

if it was sold as a new car with 1000km and wasn't explicitly billed as a demo, I have a feeling a lawyer will have a field day with this.
