Your car can be modified when bringing to dealer...if it's with OEM parts (i.e. TRD parts).

Get an estimate to fix the car from any shop.

File a small claims in S.D. v.s. the dealership for as much as possible.

SHOW UP ON YOUR COURT DATE.

Collect judgement vs. the dealer as they will not show up.

Collect (Try sending a bill to Dealership's Accounting (Accounts payable) department with demand for payment, don't know if this will work, but try it anyhow). They'll have to get their lawyers to approve it, but eventually you will be paid solely based on the judgement you've received. Give it a shot.

if you take it to court, the fact that you tampered with emissions components might work against you as well.

Not likely in small claims.

Hey, 2-5 hp lawnmower is deadly. lol

Like CrazyP said, go back to the dealer and bring out your ace card and mention the Magnuson–Moss and we'll see what they'll have to say. Good luck.

PS: put your cat back. 2-5 hp is not worth destroying earth.

Sorry to say, but take it like a man. You supercharged and removed the cats. And I'm sure you did not just dive it on Sundays to church. Come On Dude! Just fix it yourself and upgrade on the way.

Looks like he's phantom supercharged. That's the electric one. He's barely at 215-220 hp with that. The transmission should be able to handle that.

Actually, it can be modified with any parts of your choosing.

Just don't make it difficult for the dealers to do warranty work if the mods could be directly attributed to the item(s) being warrantied on.

The point is not whether the transmission can handle it or not. The point is whether the manufacturer's rated capacity of the transmission is exceeded or not, and whether it is under warranty.

If you run Z-rated tires, you can easily go 170+MPH on them. Whether or not you can is a different story.

Only reason would have to be tranny related, maybe if you had an aftermarket clutch or even a short shifter. It's like them saying they wont fix my sagging bumper because my catless header gave my car enough power to cause enough downforce to mess up my front bumper.

Torque is up around 40-50 lbs-ft to the wheels throughout most of the RPM band. That's fairly significant.

Isn't removing an aftermarket supercharger so you can get parts warrantied called fraud? You took the car beyond its OEM-specified power and it broke. Whether it should have broken or not is beside the point. If you want to play, sometimes you have to pay. This kind of behavior was rampant when the STi came out, and that is exactly why Subaru is so leery about approving any drivetrain warranty work.

Beyond the supercharger, the cats miss can have some mechanic not willing to work on your car. Not knowing what you have done to the car. Some shops will not even let you bring it into their garage do to the fines. I was told that a car found not to have all cats install would be impounded and fined $2500.00 a day till it is returned back to stock by the owner at a state garage. Not one of your choosing. I could not imagine what the fine would be for a shop.
Even in diesel shops in Calie, will not speak of altering/removing a cat.
