This. It's becoming all too commonplace for people that are blatantly at fault for an accident to deny it outright, or try to say that you were the one that caused the accident - resulting in many no-fault or partial-fault claims that should be cut and dry with the offender being fully responsible - just as the OP's footage shows, and also demonstrates that minor accidents happen so often, and so many of us are all too busy with work, getting kids to school etc, that it's even becoming rare for a witness to pull over to help provide clarification.

I would like to think I would have seen that car coming, but you never know...

Hope I never have to use my dashcam for this purpose. But i have it if needed

It's a case-by-case and situation dependent basis, you also have to consider any laws or insurance regulations, statutes etc. relevant to your state.

If the customer is adamant they're not at fault, then we just have to defend them/support their position. We create a theory of liability through diagrams, damage photos, statements etc. then proceed with the defense and/or pursuit of our damages (if applicable).

Auto liability claims is a messy business, it gets more complicated/worse if injuries are involved. Also, most of the people we have to deal with on a daily basis generally aren't nice, professional, nor reasonable etc. I'd like to leave this business/profession asap.

I was once driving through a parking lot, and a guy backed out of his spot, brushing the side of my rear right bumper with his rear bumper. My REAR bumper, meaning that almost entire length of my car passed him already and he still hasn't noticed me and kept going. Despite that, he still insisted it was my fault, he said I was speeding. Because there was no damage at all to my car, just a faint trace of his bumper paint on my bumper which I just wiped and it was gone, I agreed to split fault just to avoid the hassle. He probably had to touch up his bumper.

Wow good thing you had the dash cam. Can't believe the insurance company had the audacity to say you were partially at fault after seeing that it was clearly their fault.

Let's say that one did see the car coming. What do you do?

Maintain speed and direction? - we see that didn't work

Slam on the brakes - maybe get rear ended, may get hit in the front of the car, maybe avoid the accident.

Speed up - maybe fun into the car in front of you, might have avoided accident.

Swerve - which way? Left, get rear ended; right, head on collision.

And then we mix in the possible reactions of the other driver ...... is he going to slam on the brakes, speed up, swerve, maintain speed?

What would you have done, if you had seen the other car coming ..??

No, they only started to claim I could be partially responsible until they saw the video. They accepted full liability after.

Difficult to say. The best option would be to accelerate to get out of the intersection and brake before hitting the car in front. I only needed to get about 5 feet ahead to keep from getting hit.

My fear is that if I did see him and hit the brakes, I would have been hit right in the door and suffered more injury. A lot of the energy from the accident was absorbed by the 180 spin.

Yep, it's sort of like seeing a deer on the road ....... what's it gonna do ..??

Where are the other drivers around you....what are they gonna do .. ??

Hard to say what you'd really do in the moment, but I can say one thing... I pay more attention than most people while driving. If I could see the car in the video before he entered the intersection, I would have seen it in real life.

GoPro video saved me when I t-boned a girl with my motorcycle. She didn't see me and pulled out in front of me to cross a couple lanes of traffic. No signals, failure to yield. It was all clear on the video that I provided the police. She claimed it was my fault. That went out the window quickly

There's no guarantee of that. The camera isn't in the same spot as your head, so it's got a different point of view. It's also got a wider angle of view.

You forgot the Takumi option/technique: Cut the steering wheel hard left then hard right and grab the hand brake. This will initiate a 360 degree pirouette to let the offending car pass by you and then when you straighten out again, keep driving like nothing happened. The driver of the other car wouldn't even see it happen since he was obviously clueless, anyway.
