If you both were merging into the same lane you're both at fault. If one of you can affirm that you had the right of way, then the other was at fault. Were either of you turning or merging onto the freeway?

Two lane road at that point, both of us in the left lane and merged to the right lane to pass slow traffic. Sounds like a 50% at fault accident. Especially since she conceeded that she was driving "pissed off" and floored it past you, if Texas is a 50% at fault state.

Did you mention the "you were pissing me off" quote to the cop?
I feel like that would have demonstrated that she was not operating her 4,000lb vehicle with a clear mind and proper/defensive attitude.

She sounds like a real piece of work (and her husband too)....

Still.... If you were late into the lane, I guess she would still have right of way...

Not really, because all I was doing was changing lanes to pass slow traffic, I just happened to be doing it at the same time that she was so she felt that I was repeatedly cutting her off. I wasn't doing anything illegal or even rude imo. It's not like I was intentionally blocking her.

It's irrelevant anyway, because as soon as the cop realized it was a "his word against hers" scenario, he ignored our stories and just based his report off of the damage and point of impact.

Considering my car was damaged in the front and hers in the back, I am 99% sure I'll be found at fault. As I said before, I was driving aggressively and being confrontational on the road, so I deserve it regardless of what she was doing. I'm not gonna go out of my way to fight it.

At least I can admit that what we were doing was wrong. Unfortunately I doubt she'll ever come to that conclusion.

Props to you for keeping your head on straight and at least admitting partial fault that contributed to the incident. Also for realizing that this could be karma for some of your past poor decisions. There are ever fewer people in this world who will accept the consequences of their own actions. You have my respect.

Absolutely fking yeah, kudos to you for man-ing up. I don't know the gazillion times I've been in a fix due to my over-enthusiastic driving which could be so easily avoided by just (no pun intended) taking the high road. With my many years living in LA and typical 25k miles/year commute, I have encountered a plethora of 'duels' with other dim witted ones.

Live and learn. Now with a good no of years under the belt, I do drive defensively. That said, one does forget and tend to slide back to the aggressive, I-am-invisible, clear-out-the-carbon stance once in a while. Until at least we come across a heart-pounding situation and/or read a thread like this.
