Sorry to hear about the outcome, I think that's unfair. The XB is a little bit responsible for not being able to avoid an accident. That driver should have seen your girlfriend trying to turn and slowed down. Even if the XB had the right of way, it doesn't matter! I always watch out for people not yielding at intersections, in fact I EXPECT them to do so, that way I can avoid potential accidents and partial liability.

It's hard to say that the XB was partially liable. We did not get to hear the XB's side of the story. Or if I remember correctly, there are no photos of the point of impact to the XB. Add to this fact that the police report will show her to be at fault, her insurance company will probably not be able to subrogate against the XB's insurance. Even if they try, they will most likely lose in arbitration.

Plus, some states do not have comparative negligence, its either all your fault or no fault at all.

As a former transit bus operator, I can tell you one of the things you are taught in training is to NEVER wave another car or person across the street. If you do, then you open yourself up to liability, and that other person is liable to be stupid and assume you checked the surroundings for them, when in reality you're only telling them, "I'm stopped for you," not, "I'm stopping all traffic for you."

Some accidents are unavoidable. Had a similar accident were a old guy ran a stop sign while I was going through the intersection tried to avoid him by turning but the he just coming towards me. The girlfriend is a 100 percent at fault for creating the unsafe situation, sure the driver may be able to avoid it but at what cost they could end up in a more serious accident.

*update*

She got about ~8k for her 2009 focus with 65k miles on it and used it towards a pre-owned 2014 Corolla LE with 10k miles on it for 17900 OTD.

The white on this car looks gorgeous, and I gave her my stamp of approval

True. I'm still sorta fumed about my accident. A teenage girl (who had a stop sign) pulled in front of me at an intersection. I braked, ABS kicked in, still hit her. She got a citation, I did not. I ended up being 20% liable. My insurance company fought for me, but the girl's insurance company just really did not want to pay for my car. They were very rude to me on the phone too. Now I keep my foot resting on the brake pedal at every intersection, ready for another idiot about to wreck my ride.
