Sure on add-ons, but certainly frowned against this by Scion for First86 cars. Processing fees can be whatever they want it to be in FL, but I think it must be the same amount on every car sold.

If this guy was trying to "negotiate" a price lower than MSRP, I don't blame the dealership for selling to someone who is willing to pay MSRP. Why should the dealership have to put up with a customer playing games with them? He was trying to toy with them to get a better price and now the car is gone. If he came in and paid MSRP, he would own the vehicle now.

From my impression of OPs post I think he was negotiating his monthly payments, not the actual price of the car. Monthly payments can be negotiated as long as your going to end up paying the full MSRP of the car. Nowhere in pure pricing it says they cant be.

So basically we can assume he was offered a high interest rate with super high payments and the dealership wasn't wanting to deal with it so they just avoided him and made the easy sale to someone else.

It took 18 days to get my deposit back.

I was one of the first 86. On 20th of April I went to the dealer and told them that I am not going to buy the car and asked my deposit back. (I still like the car, but after checking the back seat in NY Autoshow I couldn't convince my wife (and myself) that this was the right car for us. (By the way I didn't go to to the LA trip since I was not sure at that time whether I was going to buy the car.)) After waiting for 15 minutes I was told that their accounting department was closed for the day (although they were still trying to make sales). I stopped by again on 23rd of April and they told me that the sales person who accepted my deposit was not there. I stopped by third time on 24 rd of April (Tuesday) and after waiting for another 10-15 minutes the sales person told me that my check can only be mailed to my address and I would receive it at most in a week. I never received the check in the mail. I sent an email to Scion on 1st of May, and got a reply on 3rd of May indicating that I will receive a call from the dealer in two business day. I called Scion again on 5th of May and told them I haven't received a call yet. They told me to wait till end of 7th of May. Dealer didn't call me and I called Scion again on 8th of May and they told me that they will sent another email to the dealer and the dealer will contact me in a day. Then I got frustrated and asked them to call the dealer and hold me on the line. Finally, the dealer contacted me and told me that I can pick up the check. So it took me 18 days ( 4 dealer visits, 1 email, 2 calls to the Scion) to get my deposit back. If I had known that It would be such a hassle to get my money back I would have never signed up in the first place. This is it no Scion for me . Don't get me wrong FRS looks great and I am sure that it handles great, but I can never trust Scion again.

The dealership was in possession of your deposit the whole time, and they controlled when it was returned to you, not Scion. Scion can only ask them to do things, but since dealerships are independently operated they take care of the day-to-day actions.

I'm sure a good lawyer could argue that the First86 program constitutes a contract between Toyota and the OP. And since the OP did not refuse the car, Toyota would be in breach of contract. Even if the dealership is a separate entity, Toyota needs to ensure that its end of the contract is fulfilled and the OP gets a fair chance to purchase his car. Having a deposit with the dealership and not having asked for it back, indicates a willingness to purchase the car as per the contract.

As I see it, Toyota needs to find another FR-S that qualifies for the contract and have it delivered to the dealership for the OP to purchase. It's up to Toyota to deal with the dealership accordingly.

Considering that another delivery issue was met with a Toyota Rep arriving to personally oversee the handoff to the customer from start to finish tells me that Toyota is serious about the First86 program. So hopefully Toyota comes to a satisfactory solution for the OP.

And this is why we only do non refundable deposits. I can understand that someone might need to go set up financing elsewhere, or sell their current car privately or anything else like that. But we do not take a deposit from someone so they can think about buying a car. All cars stay available till someone BUYS them. Taking a refundable deposit only takes a car off the lot that could otherwise be bought by a customer that is sure they want it.
Now, the first86 program is a whole nother story as those rules were set by Scion.
As far as the time to get your deposit back.... Shame on the dealership. The first thing about accounting being gone and them still making deals I can understand, we don't need accounting to sell a car but we would need them to refund a check or credit card to someone.
After that anyone there should've been able to help u get your money back and not just your salesperson. That's just bad customer service.

Ya do realize that non-refundable deposits are basically illegal. If you don't provide goods or services, it's called theft. Just say'n.

No I just was trying to see If I could Lease it, and what the payments would be. Since Scion didn't have a leasing plan for it it took some time. Also I never even knew the dealership had the car in its possession. I wasn't supposed to even have to make a decision until I test drove it, and I never had the chance. Also I never said I wasn't going to buy the car, they just assumed since I wanted to know what the lease pricing was.

Not if it is clearly stated that it is a non refundable deposit towards the purchase of said vehicle in the contract that you sign and agree to. We've been in business for over 11 years and that's been that way since the start (many dealers in MA have non-refundable deposits). Never had an issue with it, we've had many people ask us if they can leave a deposit to hold a car and we simply say that we cannot accept it because that would take the opportunity away from another potential buyer who is sure that they want to make that purchase.
I just don't see the point of a refundable deposit. Think about it, get everything in order and then make your purchase. I think it's the only way that is fair to everyone including the dealer and other potential buyers.

In this case the customer had a refundable deposit so this one as far as we can all tell is all on the dealership and it's inability to promptly refund the customers deposit.
