From a legal standpoint, the apartment people are probably not going to admit fault until they're in court. If you were in Ohio I know a few good lawyers.

So I am arguing this with my wife(who is almost a lawyer), and we came up with this.

It's a clear cut argument of an act of god. Simply put, unless you can prove negligence there is 0 case here. And proving negligence would be very hard to do. Now if there is prior proof to the integrity of the carport being sub standard, or compaints have been made by you or others as to its condition. Then you might have some chance. Documentation will be paramount in this regard and again it will still be a hard case to prove.

However with that being said, if you do sue, and are successful in your case of negligence. Then you can recoup your lawyer fees on top of your damages.

Insurance is your best bet. Sorry to see your car like this. Those photos hurt to look at.

Insurance will go after their insurance since they ARE at fault for not reinforcing the supports to endure easily forseeable weather conditions.

Now, if this were to happen in AZ, it would be a pure "act of God" as it would not be forseeable (since we just don't GET snow in this part of AZ). But where you are? Regular and foreseeable. the complex should have taken all reasonable and prudent precautions. that they failed to do so leaves them liable. easiest way is to go through their insurance as your insurance is already doing.

Nope!

I have sent them an email and they told that they will get back to me. Sent them the email last week, haven't heard from them since. I too have been out of town for work this week and am hoping to meet them this Saturday.

I want them to pay my deductible or at least (being the inconsiderate human scums that they are) pay half of my deductible. They just don't seem to care about this at all. This happened entirely due to their lack of maintenance and lack of quality products while building the carports. And my car comes underneath their laziness.

I live in SE Michigan. So, this happening because of snowfall shouldn't be a problem. Snowfall is expected here and their construction should be able to withstand that.

Yes, I have told my insurance company to 'represent' me in going after them. I'm assuming they are going to go after the apartment insurance company to get their money back once everything is handled.

Let your insurance handle them. Be in contact with them (your insurance) & let them represent you. That is part of what your insurance premium pays for. Make use of it.

A lot of times, lawyers are there for a reason. Yes they might not intentionally ruin your car, why would they? But ppl just dont know being lazy on there job comes with consequence. may not happen right away, but it will. All most all the maintenance ppl I have encountered in an apartment complex have the same attitude. They would only learn, when they get a person stuck under there because of there negligence

Just a quick update.

My car is back and purring as sweetly as ever. The guys at Autometric did a fantastic job on the car and I'm pretty happy with it. The paint is clean and blends very well with the car, which was one of my major concerns. They ended up replacing the hood, front bumper and the left front fendor. They didn't take the roof off and did a great job on the existing one. I wasn't sure about replacing the roof, as that would mean taking off the factory welds and messing with the cars rigidity. Autometric suggested the same.

GEICO was the main hold up. They were just crammed with a lot of claims and couldn't get everything done quickly. Else, I was pretty satisfied with their service too.

Also, the apartment douchebags have agreed to pay my deductible. At least I didn't have to pay anything out of my pocket. I'm still planning to use the carport, but not sure if it's a good idea!

Lastly, thanks to everyone in this thread! You guys have been very supportive and helpful! I love this forum! Time to make some mods now!
