There are times when it seems appropriate to get a lawyer and fuck someone. This would seem to be one of them.

I can't stress enough what Tromatic said: Get a lawyer. Don't mess around with this. The ass that hit you would have killed somebody less aware. Hidden physical damage creeps up all the time. After you get a crummy settlement it's to late to complain. Get a lawyer involved as soon as you can. Tell your insurance guys that. They can deal with his insurance guys. Take your time getting things settled. Strongly advise you to get a lawyer involved. Someone looking out for you.

Holy fuck, 80mph? This is one of those times when you have to say yes, it's just a car and you could've really gotten killed. Glad you're somewhat ok.

Holy crap! That was some good thinking and good reflexes to drop the clutch like that to make the most of a unwinnable situation. I'm glad you're OK, but make sure to follow up on the doctors.

It's unlikely but make sure you ask. And ask with some authority, afterall he hit you and his insurance needs to now do their part.

You also have insurance so if his is unable to make you whole, yours should but it should need to. Be aggressive going after his insurance company, don't be timid.

The fact that you have documented medical expenses means you should be using a lawyer to get monetary compensation for this.

At this point you'd get more money for injury than aftermarket parts, but you can throw that in as well. Since their insurance is taking care of it, prepare all receipts of parts on the car (and pictures as backup if any).

Also: find a lawyer willing to take on this case without payment up front. No out of pocket expenses for you and you'd end up with a lot more than you started.

The other driver was dumb enough to admit guilt, now make his insurance pay for his mistake.

Good luck!

If they don't total your car, my thread may be some help.

I'm not sure why the twins keep getting rear ended. I'm not sure if our cars are too low or people just suck at driving.

My theory is that that the twins can stop quicker than 95% of the vehicles behind them ..... that, plus 75% of the drivers aren't payen any attention to what their are doing while driving......

It amazes me how many people are distracted from using the phone and driving.
You know what baffles me?
People with a phone that put it on the speakerphone and holds their phone near their mouth. (Bad wording) What's the point of speakerphone than?

I feel the same way, I used to sandwich my phone between my chest and the seatbelt, or throw it in my chest pocket in my shirt/jacket if I had to talk on the phone. But generally I'm distracted enough so I hate talking on the phone while driving.

Brutal. So sorry for your loss. I'd say glad you're OK but it doesn't sound like it's guaranteed yet.

Like others said, lawyer up. And don't even speak with the other driver's insurance company any longer, nothing good can come of it. Their interests are the opposite of yours.

Take care.
