How is he an idiot for stopping? What if he had a seizure or a heart attack and he accidentally slammed on the breaks? You have to be prepared for anything when you're driving man. The driver behind him should always have enough room to come to a complete stop at whatever speed they're going. There's no excuse for driving so close behind another car that you don't have enough room to stop. It's common sense but people still drive so damn close to each other.

It looks like OP was at a safe distance but the real idiot here is the driver behind OP.

He was at a stop, and being Pushed. Air Bags won't deploy at under 20 MPH impact.

I hope you get it worked out. You will get more out of insurance with the right Lawyer, but before doing that, take in consideration of the Fee your Lawyer may charge.

Wish you all the best luck. I am too, don't believe in other drivers beside self. I got an Idiot almost hit me in the same way, I saw him coming from the Rear Mirror, I was eager to do something, but I couldn't. I couldn't even stop braking because the guy in front of me totally stopped.

This happened 10 months ago. I'd like to think he has gotten it cleared up by now and is already driving a replacement.
