Based from this, the dealership has failed to follow their self imposed conditions. I'm pretty sure this will not fly in court! (you've already won)

Also unless you ordered a highly undesirable / unpopular color, then they are guaranteed to sell the car. They should refund your money. On top of that were you made aware of a non refundable deposit policy before you agreed to make a deposit? (once again, a policy they've already violated)

I asked another dealer about this once. At least in Canada, they are allowed to deduct from the deposit what came out of their pocket to deliver the vehicle(mainly the gas to fill the tank). Most dealers with spine won't keep your refund, especially on a car this hot...he could litterally flip it the same day.
