Most insurance companies are set up to pay diminished value. It is something you have to ask for though since they will not offer it up front. I suppose you could take them to court if they denied it for some reason. Also need to keep in mind that the diminished value payout is based on the depreciated price of the car and is not intended to bring you back up to the purchase price.

Not in Canada they're not.
There has been one documented case of someone successfully winning their diminished value claim against their insurer.

Sorry I should have been more clear. Many companies in the US offer diminished value. Even then it depends on the state insurance laws. My reply here was focused on the OP who being in California is in a state where they are eligible.
You are shit outta luck for it here in Ontario. I know because we tried a few years back when my wife got hit in a parking lot. Did you know that the Saturn "no dent" body panels do indeed not dent in cold weather? They explode like a bomb and send shrapnel and shards everywhere.

Make sure you get proof how much the of the car's value is lost thought. Been in the same boat and the insurance of the party at fault tried low-balling me when the repairs were almost $12k and brought my car's value down almost $4k from KBB value. So I went to carfax and other dealers to get the car appraised AFTER the accident and paid an accident lawyer to get my money back. It's such a hassle but it's money you deserve if the accident is not your fault.

If you don't want to get rid of the car, if they total it you should be able to buy it back from them for less $$$. Should end up being cheaper in the end if you do intend to keep the car for life, just my $0.02.

That being said I'd totally take this as an excuse to upgrade to a MT. But I am biased

Good point. I'm not 100% sure, just something I heard other people commenting how they bought their cars back from insurance.

Good news! Her insurance approved the repairs. I spoke with the body shop I am using and they said it's all parts replacement and paint, no frame or drivetrain damage. The final estimate is $13691.81. Estimated repair time is 14-15 days (forgot to ask if they meant business days. probably is). So happy.

I am going to attempt to get the diminished value on it, but I gotta look into the steps. Thanks everyone.

Nice! If have expected frame damage on the driver's side, though minor. It looked like a bit of a pinch. Good to hear that's not the case and my guess was a little on the high side.

Sorry to hear that.
It will never be the same again.
I would have pushed for total loss.

Not within the write off threshold. Pushing for total loss would be futile.

If you know someone at the body shop, they can have it written off.
I've been close to this industry for a lot of years.

Of course it won't be exactly the same.

That doesn't mean that after it's repaired, he won't be able to enjoy driving it as much......

Spoiled goods.
I've never been able to enjoy the same love affair with a vehicle after a repair like that, than before. I just stop caring. I don't wash it as much. I don't care about where I park it or door dings. It's just lost.
It's probably just me though.
