I'm on the central coast in SLO county. It could very well be CARB legal. All you would need is the CARB legal tune from Jackson which I think you can get for free. I actually have the original CARB tune from Jackson on a flash drive but I believe it was for the smaller C30 blower I originally had. Not sure but I'm guessing the CARB tune is slightly different from the C30 to C38 but I never ran a CARB tune on the C38. This kit is definitely CARB compliant with the right tune, standard pulley and 91 fuel.
