Keep in mind you are in different countries. It can be difficut to insure a branded car in Ontario. People often end up paying more for less coverage.
Check with your insurance company before deciding anything. Don't rely on some shay Florida man to say it is OK.

LOL true. Across the normal 50 states in the US it should be the same for national carriers but up in the land of our 51st state, good ole Canadia, go check with your insurance carriers aboot that.

I'm just curious and I'm sorry that this is a little off topic: Are you or maybe your insurance going after the shop in any way? Or is there not enough proof to hold them liable?

Well yes of course, but the decreased payout is probably still to be expected; which is the part I hadn't considered.

So the shop claims it is not their responsibility and they only said they would cover my deductible. It's all based on their policy, and honestly I don't feel like getting in a lawsuit if insurance will cover without causing a rate hike sure to it being an act of God .

Garage
I would think that the shop would be responsible for the damages, it is not unreasonable to expect that your vehicle is returned to you in at least the same condition as when you left it. If they have a garage liability policy make a claim against that, but I would expect that most small shops don't have that and you would have to take a legal route.

If you really want to keep it, you have a few options, each has its pro's and con's
1. Let them total it and try and buy it back
Pro's: You are familiar with the car
Con's: The price they sell if back to you for is usually not as low as you'd think, some insurance companies will not sell them back at all. Car will be branded with a salvage title, depending on your state, to get it titled (rebuilt) again may require you to repair all the damage (or if it will never see the street again, you can leave it salvage).
2. Cancel the claim
Pro's: Title still clear
Con's: Have a damaged car...could fix yourself....
All of my buy backs were super easy. They just took the book value and subtract it from the repair cost. In every case I found a body shop that fixed it for like 1/3 of the quoted repair cost from the adjuster. My title remained the same, but the accident did show up on the carfax. Just my personal experience, but everything worked out in my favor.

Build a competitive and reliable fully prepped race car in SCCA T4 that can still be street legal if you want it to be.

Full prep, complete and competing on track can be done for ~$12k if you’re a bit handy with a wrench and get a good deal on a cage.
