this worries me for folks. I've never touched the stuff so it doesn't concern me but I wonder if people have thought of this.

there's no good test to tell how much and how long ago a person smoked the stuff. all you can tell is that if someone's been exposed to it in some span of time. what if say you got baked on Friday and got into an accident and hurt someone on Sunday totally sober. they drug test you and Wamm-O there it is. how can you prove you weren't high at the time of the accident and that it was days since you touched it?

maybe there's something I'm unaware of here but I based on what I've heard/read that opens up folks for a lot of possibly unjust trouble.

They did think of it. The same rules as drinking apply. They would test blood level not just if it is there.

"legal limit" is a misnomer. There is no legal limit for alcohol. If an officer thinks you are impaired, it does not matter what your BA level is. They can and will write tickets for .03 that hold up in court.

This.

The legal limit is just the threshold where you automatically get a DUI by blowing over.

People can get way too intoxicated to drive from one beer (or just one puff) and this is where the officer's discretion and other roadside testing comes into play.

It's still pretty new territory for police and I don't think a solution will be reached easily or quickly. The way THC is metabolized and how long it stays in your system is completely different from alcohol and is still not well understood. Presence in your blood is also not a good indicator of intoxication because it can stay in your system for MONTHS depending on the individual.

True but there are still the legal limits as worded by Ontario law. Pretty tough for them to make charges stick if under those limits around here.

well that sucks. all it takes is the officers decision and you're guilty? that's terrible. our "legal limit" here is 0.08 BAC.

IC. well here if you go in for a blood test they're going to lock you up because they think you're "impaired". happens here all the time even after people pass the trick that is the field sobriety test. your only hope is to beat in court. as long as you're under the limit a not chitty lawyer can get you off here. of course it also depends on where you get arrested here as well. some places will take you to jail almost no matter what. .0001? better have bail.

It's 100% true. They can write a DUII for ANY amount of any intoxicant, if they think you are impaired. Even for drugs prescribed by a Dr.

Idk, if I have to slow way down to like 30mph on an interstate because I can't see more than 20ft in front of me, I'm gonna put on flashers just in case some dumbass doesn't properly assess the risk of going 70mph in the same conditions. It's helped me to identify slow moving vehicles before so I know something is out of the ordinary.

The reality is that legalizing pot is not likely to create any increase in impaired drivers anyway. It isn't like that stayed at home and didn't drive when it wasn't legal. Also not going to see this mass of people going "Oh it is legal now I think I will start smoking it". Since the legal stuff costs more than the street costs there will be no real impact on the dealers either. All in all the whole legalized thing will change nothing except court dates.
