How bad is this tire tear?

That crack is bad. Heat will build up in that crack and could cause the tread block to break off. Send that tire back for a warranty replacement.

The red areas of the tire are where the uncured tire did not fill out the mold properly during curing. All of those red areas should look like the green areas. These are manufacturing defects; that tire should not have made it out of the factory.

Both of these reasons are grounds for a warranty replacement of that tire.

Hey DM7, that tire tear was from my rear fenders rubbing, my fault not the manufacturer. I just wanted to know if I could live with it or should I just replace it outright.

Is everything I pointed out just damage caused by rubbing? Now that you mention rubbing that's probably what all of those defects are. That puts my mind at ease knowing that a tire company wouldn't sell something that looks like that.

I would replace the tire. I would also; run a higher ride height/remove spacers (if you have them)/get correctly sized wheels and tires to prevent rubbing.
