I got screwed on a deal in classifieds- do I have any recourse?

Recently I bought a Unichip from a seller, ndreim in the forums here. It hasn't worked right since I got it and after a bunch of emails with Jack@unichip we've come to the conclusion that I got a bad Unichip. It works for a few days then the LTFT goes nuts, the car runs very rich, CEL, and in the end I tried a lot of different tunes, but always the same result.

Ndreim won't refund the money, saying he has no money. He also claimed he had problems with the Unichip too, so he sold me his problem. I left a bad seller review, but that's not worth much. Do I have any sort of recourse? I assume my money ($180, PayPal ) is gone, but what about the seller who screwed me in the deal?

How long ago is "recently"?
How long did it work before screwing up?
How have you confirmed it is indeed the Unichip?
How many people told you that you were throwing your money away buying Unichip in the first place?

Depends:
1. Did you send money via PayPal as a payment for goods (NOT as a gift)?
2. What exactly did the original sale post say?
3. Did you write any notes in the PayPal payment to the guy?

This is why I always use PayPal and pay for stuff as goods and services. Also always leave a note in the payment describing what you expect to be receiving "Genuine, working, used unichip for FRS"

If you can prove that the seller sold the unichip under the pretenses that it was fully functional, and you didnt send money as a gift, then you can just open dispute with PayPal and get your money back. Doesn't matter if he has a $0 balance in PayPal, you will get your money back and his balance will go into the negatives.

Paypal has a remediation service for this, assuming you paid through him as a vendor and didn't work the system by claiming he was a "friend". I've used that very successfully in the past in other situations.

As long as you didn't send the money through paypal as a gift I would open up a claim. I believe it is a 30 day window, so get on it.


Although, it took you 20 plus days to figure out a problem? That is an odd scenario, but paypal will still likely side with you and credit you and lock his account.

It would appear that if the seller had "claimed he had problems with the Unichip too, so he sold me his problem" he would not be telling others to pick one up weeks after he sold his http://www.ft86club.com/forums/showp...38&postcount=9

Wasn't really taking about just this thread but sort of in general (other than the last part of course).
I guess it is just whoever pipes up first that gets the sympathy. If the vendor came on first and said "I shipped a perfectly good part and now the guy says it doesn't work and want's their money back" then the majority of the replies would probably be "tell him to go screw himself"

20 plus days isnt an issue. I once returned a used set of Volk lug nuts after like 3 months because I realized they were fake. Took 3 months because they were put away until my new wheels were ready.

Paypal dispute window is half a year, or like 180 days.

I couldn't remember. I do a lot of online transactions and only been burned once, as a seller, and it was literally on day 30.

I like to see both sides of the story, but I figured I could help the guy with paypal issues.

Yes, it took this long to troubleshoot because of the nature of the problem which in the end (emailing Unichip isn't the fastest way either) and we came to the conclusion that the hardware is the issue.
