I went back at 15:15, and he still wasn't there, but a surprisingly nice guy helped me. I thought this guy was being dodgy and dismissive when I visited earlier, but he was just being straight earlier, so this time he called the owner.

I spoke to the owner on the phone, and it was hard to hear him, but he immediately sounded like an honest guy--at least to me. He offered to refund her.

We left and went back to the house. I basically said that if he wants a $250 restocking fee then we will take it because, at this point, we just want the $4k deposit back and be out from under this vehicle.

We returned at 16:45. He showed up a little after, and we talked it out. He was a nice guy. He tried to impress upon me that he doesn't have to bla bla bla, and that their agreement was bla bla bla, in which I said that, "I don't want to take this to a mechanic and make you responsible for a $4k bill to get this thing smog legal." If it was just her then I'm sure he would have walked over her, but he realized I knew the law, and I knew the nature of the situation, that there was a lack of full disclosure, a lack of a smog certificate, a possibility where he could be on the line for expensive repairs and a disgruntled review/customer.

He fairly suggested that if she was to rent a car that she would need to pay per day, and it had been ten days, so he asked for $250. I said that it sounded like a fair compromise, so both parties feel good about the deal.

He checked out the car then cut a check for $3750. We left happy, and my niece said a huge weight was off her shoulders. She asked me to keep the money, so I could help her get into something better. Until then, her grandmother (my mother in-law) is letting her borrow her old Camry.

Pretty stoked the guy was nice and that we were able to civilly resolve the problem.

On a separate note, the guy had a few gems there that were in equally poor condition as the rest of the "auction" bought "fixer uppers". He had a pastel green 968 Porsche convertible, a silver Maserati, a pumpkin orange BMW 850i, and a few other cool cars. The rest of the vehicles on the lot were obviously bought cheap to repair and flip.

great to hear the guy actually worked with you on it all!

the even better news is that there's now reports that the used vehicle market is starting to cool off(intial-covid, used car prices were skyrocketing), so moving forward, it's going to be easier to get something a little more reasonably priced..

Yeah, I am sure the market should be good either way like now or later. I would imagine anyone with cash is probably in a good position to buy, and I'm sure a number of people are trying to sell their car just to stay afloat.

Only negative right now is her credit was dinged for having it checked and taking out the loan. However, I think if it's within 30 days, auto fico score checks don't get repeated dings on the score.

This was not the case because she had done the financing through the dealer and not a bank. No credit check. Buy-here, pay-here type of place. I doubt he even sent the registration or any paperwork to DMV yet.

Oh dang, straight up "pot lot" dealership. Well, at least she wasn't dinged on what ever credit score she may have at her age. Although, it would be a good time for her to start building her credit (she would need a co-signer in order to not get super high rates). I would stay away from dealerships like the ones she went to. Stick with either manufacturer's used car inventory, or places like CarMax. Yeah, will pay more for the car, but more likely than not, the cars will be in better shape, and there will be less sketchy things going on. Just look up reviews on the dealership first since we all know how shady some are (looking at you, the now gone Momentum Auto Group).

Glad everything worked out for the most part.

Now, it's time to give that niece of yours a stern talking to. I mean, I made sure my brother tells his kids NEVER to buy a car without consulting either me or him first.

If they DO decide to buy a car without telling me or their dad, I told them I will personally come over and beat the s*** out of their car with my tire iron. I guess I'm playing the crazy uncle role, but who cares as long as they get it firmly in their heads to consult one of us first before making the purchase.
