I believe the notes on the ticket actually state how long the cop has to file this. Its not new.

The notes on the ticket which tell YOU how long YOU have to respond are not new.
If the deadline for the cops to file has changed from 24 hours, and it's written on the ticket, that's all new.

The deadline has not changed in at least 30 years so I am not sure where you got this 24 hour thing from. No bureaucracy in the world would process such documents in 24 hours even in this computerized age.

Does anyone have a recent ticket from a cop? I don't have any but I'm pretty sure it says how long the cops have to file it as well as how long you have to respond to it. I haven't had a ticket in a while.

They do not say anything about the cop registering. Why should they? The Provincial Offences Act lays it all out. They don't need to write the whole Act on a ticket.







In this case he didn't receive a "ticket" he received a summons. It is a whole different ball game since he MUST go to court (or at least settle with the prosecutor. There is no option to just pay off the fine.
Getting legal advise on a forum is a bad bad idea since as we have seen there are a lot of myths or misunderstood rules that people seem to think is a loop hole. There really are not as many loopholes as people think since the courts have heard it all before and are pretty good at closing them up.

You have no idea what you're talking about, so just stop.

A police officer has 7 days to file a provincial offence notice. It has been like that for a long, long time.

The driver has 15 days to reply.

I spent some time looking through the archives on this.
When the Act was passed in 1990 It was phrased as "A certificate of offence shall be filed in the office of the court as soon as is practicable after service of the offence notice or summons" So, that was obviously not clear enough because what exactly constitutes "as soon as practicable"? A day? A week? A year? Whenever they get around to it?



In 2004 they changed the Act to read "A certificate of offence shall be filed in the office of the court as soon as is practicable, but no later than seven days after service of the offence notice or summons". Now there is a clear and defined period as to what they consider to be "practicable".


No place in the Act did it ever layout that 24 hours was the time limit. It went from "Ya when you have a minute" to "When you have a minute but don't go beyond 7 days".


I have been dealing with Environmental and Occupational safety law for 30 years now and can't stand the word "practicable". It is grey and open to whatever interpretation the user wants to apply. Over the last 10 years the government has been slowly eliminating it by using more specific terms but it still shows without clarification far to often.

That's definitely one of my favourites amongst other words like "shall make best effort, at their discretion, reasonable amount". Just to name a few.
Nobody said anything about whether they have examined the OP's car for "illegal" mods when it was impounded. Could they say that adding the supercharger is an illegal mod? That would be a nasty surpise when it goes to court.

Not illegal to supercharge a car in Ontario. It is illegal (federal) to change the emissions control system though so a catless header would be a concern. Highly unlikely that anybody would care enough to look at the impound yard though.


One of my favourites is "shall follow ALL industry standards" They will not tell you what those standards are or which they may apply to a circumstance but you must follow them ALL.
