(Disclaimer: I personally like the guy, he's been responsive to me in the past and for some amazing reason I would *STILL* consider his products and services)

This silence does you disservice John, man-up and talk to us.
I don't like the guy.. He was an ass to me, and that to me shows that if I ever had an issue, it would not be dealt with in a manner I'd care for and I don't care to be in a heated conversation with the guy... I mean Visconti has been a hot topic around here lately.. That said, he tuned a lot of cars and a lot of happy people rolling around with those tunes.. I think he can't comment on this situation yet.. But I'm sure he will.. I'm sure he will say something, due to the fact he will loose all the business of running our cars.. And I'm sure this will be swept under the rug so to speak like his bad threads on the GTR forum(s)

It'd be viewed as only circumstantial. The presence of the clamp wouldn't be enough to prove anything by itself. However, it could lead to other things being looked at.

It also depends on who does the investigation. I highly doubt yhe insurance company will work directly with Subaru. The average insurance appraiser would probably over look the clamp.

Again, I'm just making general assumptions, so there's no telling how the situation would or has already play out.

So what you are saying is that even if it is the flex fuel kit, the insurance company will probably not be able to prove this?

I'd guess not. But, nothing is impossible.

Garage
so i just read all the current pages on the gtr forum. i am surprised that they are having the same debate over there, with this thread repeated brought up. Also both sides are pretty much using the same points that are brought up here:

For the most part, everyone sympathizes with the owner on the loss of his fresh vehicle.

supporting VC:
-not tuners fault, installers fault for not noticing defects
-VC tunes have been good
-mods come with inherent risks
-official reports have not come out so fingers shouldnt be pointed

non supporters:
-VC supplied the parts, not just the tune
-it was a VC recommended shop that did install of the pump
-25% failure rate for the VC supplied fuel pump is unacceptable
-VC has poor service and customer care (such as charging for fuel leak fix)

But what i found most interesting is that visconti decided to comment on the GTR forums (pg 10) about a BRZ fire rather than on our forum. Interpret that however youd like.

i didnt bother reading everything but it looks like the fire was caused by a faulty fuel line being cut incorrectly, and causing it to rip etc, correct? So why are people talking about vc tunes..

I see, so unless the insurance company know about the kit or someone send them links to this forum, they won't even be looking at the kit.
In that case, there is a very high probability that john armed with the official insurance report will be saying to the non-visconti camp "you moaning idiots, I told you it wasn't my fault"

See that's the thing. Everyone is waiting on the insurance to say yes it was or no it wasn't. I wouldn't hold your breath in that.

All they will do is make sure that it isn't a fraud claim, make sure the owner is within his contract (policy) and then pay it/deny it.

The thing with aftermarket parts is that with insurance it's like your warranty. They don't care if it's modded. They won't owe for those parts unless premium was paid for additional coverage. The only time they question mods is if the mods could have caused the incident.

That could be the case here, but with the extent of the damages that will be damn near impossible to prove. They may hire a 3rd party specialist to investigate, but I doubt it. That usually only happens when there is suspicion of fraud.

That's just the thing, he's already commented on this BRZ situation; to his GTR customers that have $120k plus wrapped up in their cars.
