I find it so funny that this is considered illegal in the states. Can't bang a 17 year old, can't drink till your 21. So little faith in the American youth.

So, in fact, the situation is apparently very close to not being a crime at all. If she turned 14 BEFORE he turned 18, then it would not be a crime. In some other states, it would be a crime, but only a misdemeanor. Of course, he apparently turned 18 before she turned 14, so he could be charged with a crime if he has any sexual contact with her at all. I'm not advocating any particular position here - just correcting a misunderstanding of the law - which seems to be a common misunderstanding. I don't know which state the fellow who was 18 and took a 17 year old to prom was in... but odds are he wouldn't have been committing any sort of crime to go for it.

Incidentally, in Ohio - where there is a similar 4 year age gap provision - I represented a guy who turned 18 two weeks before the girl turned 14.
The guy was charged and convicted and did 2 years in prison (I rep'd him after he got out on another issue). Note that he didn't do as much time as he would have if he had been, say 35 years old and she had been 12 or something. If he had been born 2 weeks and a day later... or if she had been born 2 weeks and a day earlier, he would not have committed a crime.
