I find it so funny that this is considered illegal in the states. Can't bang a 17 year old, can't drink till your 21. So little faith in the American youth.

Umm. You're wrong - assuming she is about to turn 14, it will not be a felony in just over 2 years. Unless he is, in fact, a relative - in which case it would potentially be another crime (incest) and possibly sexual assault/statutory rape as well.

I've done a fair amount criminal law practice, so I have to know this stuff. The fact is that in many states the age of consent is lower than 18. In more than half of the states, the age of consent is 16.

That means that in those states, if the younger person consents to it, a 50 year old (or any age adult, for that matter) can have sex with a 16 year and it is not a crime of any kind.

The age of consent in New Jersey (where his info says he's from) is 16. Both Ohio and W.V. where I practice law are 16. As is the aforementioned Kentucky.

Further, many states have a 4 year age gap provision. For example, New Jersey's is:

"State law specifies (by not saying anything) that minors between 13 and 15 years old may, in general, engage in a consensual sexual relationship with someone up to four years older. Therefore, for example, it is legal for a 14-year-old male or female to engage in consensual sex with a person up to 18 years of age."

So, in fact, the situation is apparently very close to not being a crime at all. If she turned 14 BEFORE he turned 18, then it would not be a crime. In some other states, it would be a crime, but only a misdemeanor.

Of course, he apparently turned 18 before she turned 14, so he could be charged with a crime if he has any sexual contact with her at all.

I'm not advocating any particular position here - just correcting a misunderstanding of the law - which seems to be a common misunderstanding. I don't know which state the fellow who was 18 and took a 17 year old to prom was in... but odds are he wouldn't have been committing any sort of crime to go for it.

Incidentally, in Ohio - where there is a similar 4 year age gap provision - I represented a guy who turned 18 two weeks before the girl turned 14.

The guy was charged and convicted and did 2 years in prison (I rep'd him after he got out on another issue). Note that he didn't do as much time as he would have if he had been, say 35 years old and she had been 12 or something.

If he had been born 2 weeks and a day later... or if she had been born 2 weeks and a day earlier, he would not have committed a crime.
