speeding ticket

I got a speeding ticket this weekend for doing 85 in a 40. Not sure how he clocked me because I'm pretty sure he was moving too and I thought he was a cabbie at the time. He was easily over 200ft away when I noticed him catching up to me but I was already back down to 60. Wouldn't it be near impossible to eyeball another car's actual speed without a detector?

Also he put my car make as a Toyota on the ticket, any chance I can fight them and say it's a scion this time haha..

Cops eye-ball speed all the time. They are trained to do so. Some cops like to pace with you and see how fast they are going to match you.

Or my personal favorite, when a cop says he was going 60 (45mph zone) and it took himthis long to catch up to me. Well no duh math buddy. If one train left at one time and another at the other, one going 45 and the other going 60 how long will it take for them to meet. hahaha, but of course im always polite and never actually say anything, but its in my head.

Just last month my girlfriend and i got pulled over ( i was driving her car) and when i merged on i went straight to the fast lane practically. A cop was behind me on the freeway and pulled me over for unsafe lane change. I wanted to say to the cop, but i used my blinker so everyone knew where i was going. Of course i didnt, and because of that, thats probably only why i got a warning.

Usually on the ticket it is called unreasonable and imprudent speed. a 4 point ticket here in WI and can easily be dropped to 0 points (illegal parking on the freeway)

Ask me how many of those appear on my record

Ask to see the readout from the radar gun / proof that the speed is accurate. I'm fairly certain that he cannot cite you for speeding specifically without this. The only thing he could do is cite you for wreckless driving if it "appeared" that you were moving too fast. Oh and try not to do 85 in a 40 in places where cops patrol lol.

First off, you should never be doing 80 in a 40. If I saw you doing that, I would call the police.

Second, no and no. Theres an unwritten rule where if youre OBVIOUSLY speeding, youre going to regret it. As for a different make? Nope. All the ticket says is that the driver (you) were traveling at a rate of speed beyond the posted limit.

You earned that ticket. At twice over, youre facing doubled fines, mandatory court time, and a judge that is going to be relentless.

Well if he actually wrote you for 85 in a 40 then you have to go to court anyway. Depending what he wrote you for (if anything else) he could easily put you past 11 points on your license.

Basically what I'm saying is he has you by the balls, hope you were polite and see what he is willing to do when you go to court.

you are an idiot for driving 80 in a 40 zone. You put other people's lives in danger.

Different state have different laws, but in some cases they don't have to show you the radar reading. When you go to court and argue in front of the judge, guess who the judge is going to trust more? you or the police?

Police cars routinely have their speedometers calibrated for accuracy. It's likely he paced you at your speed before you slowed and noticed him gaining on you.

You're pretty much screwed and you're just going to have to take your lumps and move on. If you have a clean record, you may be able to request some leniency from the judge. Unfortunately, given the speed you were caught going you SHOULD have been given a reckless driving ticket which is a criminal offense. Misdemeanor sure, but still a criminal complaint which would mean that you would have to have an attorney, be arraigned and have a hearing. They aren't fun... trust me. I was young once and routinely drove like a lunatic that had been set on fire.

You should really count your blessings. You only got an infraction, you didn't hurt anyone or yourself, didn't crash your car and you didn't harm any small animals.

When you get your day in court, please take my advice and don't try and smooth talk the judge or weasel your way out of it (Toyota, Scion? the judge is not a moron). Just stand up straight, don't admit to specifics, and be VERY apologetic!
