Feasibility of figuring out current gear, clutch pos over CAN/OBD2?

Oh yeah, like in the diff?
It was used - the car was mostly stock, just had a Borla muffler as far as I can tell. I would be surprised if it they had changed that out. Its right most of the time, but every once in a while I've looked down and noticed it wasn't there or wrong.

Possible that he had removed certain aftermarket parts, but who knows. One easy way to tell is checking your RPM/speed on highway cruising. In 6th, at 3k RPM, you should be at 67 mph. If it's 3 or more mph off, then you have a different FD.
