I would look for something similar form MD's AG.

OH doesn't specify, so 30 days equals 30 days total. You can't control how many days the service department is open. Seems that it would add confusion.

I also don't think anyone needs an attorney if the steps are spelled out unless you aren't getting what you want.

Many states have a Pay-Thru provision of some type. Look for Attorneys in States which specifically say in their ads state "Win or Loose, you pay nothing". Basically, if the case is successful the auto company pays the complete costs of any legal fees you spend going after them. In those states even going into arbitration could cost an automaker more then the cars worth. The attorneys are self interested so their not going to take your case if it's a likely looser for them.

It's always worth speaking to an Attorney to see what your options are (IMHO)...

It's pretty clear to me that an engine management system which has to control the timing of spark, valve opening, fuel control over TWO independent injection systems up to 7500 RPM over a range of different operating conditions (both inside and outside the engine) is nearly as complex as you can make it. The only complexity inducing mechanism missing is a forced induction system of some kind (and that's coming).

Our cars have a 4-channel ABS / Traction Control / Stability management system with user controllable threasholds and deactivation. The stability management system actively monitors the car's yaw rate and then intervenes when the driver has exceeded it's allowable limits. There's a brake force distribution system which allows the car to vary brake force per-wheel based inputs from steering angle, brake force applied, and vehicle speed. You have an electrically driven, speed sensitieve, varable effort power steering system with it's motor embedded in the steering column itself so the engine can sit 10mm lower.

The ABS, Steering, Gauge Cluster, Air Bag, Tire Pressure Sensor, Audio System, Transmission, Engine (split up into the ECU and the FCU; Fuel Control Unit) all have independent computers which speak to each other in real time through the car's CAN BUS

Modern day cars are VERY complex but consider that 10 years ago getting all of this integrated into a car meant you were spending $60,000. The FR-S/GT 86/ BRZ are a value at twice the price. For everything they got wrong on this car, they got a lot right (just saying...)
Sounds like a bunch of expensive shit to fix over the course of 7 years. I must be one of the few remaining people that would have been thrilled with just A/C, a radio, and roll-up windows.

I've made a list of 23 cars which has been "fixed" so far. They all share same things. Cam related codes and also ALL cars had new ECU or flashed ECU.

How on earth do i get the message to my workshop that they need to change the friggin ECU and don't bother with the cam things?! They are going by their manuals is all I hear.

Quote:
They received instructions from Toyota corporate to replace the usual hardware (that others have reported here) and a new ecu.
Then, yesterday they updated me with a new instruction from corporate.
Now they are to only replace the ecu, not the hardware too.

I also checked with Scion HQ.
Darren a guy I'm sure many of you guys have spoken to during this entire fiasco
says it's not an ECU on order but just a revised flash that's getting sent.

My car been in shop since 8/31/12. Dealer just installed VVTI parts and threw another CEL

Was just told all the cars at the Houston distribution center have had their ECU flashed as of today.
And that mine would be flashed within the next few days

Engineer at toyota corp. and they responded and said ECU need to be replaced with new software.

Was just informed by my dealership and a tech at Subaru canada that a software flash will be available at the end of the month to resolve the CEL/Trac light issue.

They swapped out my hard parts and still the same issue. It was not until they gave me the newer ecu part number that the problem was resolved.

Update 2: Shop said i have a bad ECM..only one in the US according to the mechanic,
waiting for it to arrive today overnight from Cali and should have my baby back today or tomorrow.

Picked up mine this afternoon after a toyota engineer flashed it this morning. All is well. No more idle or CEL.

Just an update, they ended up just flashing the ECU. They were previously were going also going to replace the camshaft.
I'm getting my car back today.

The owner of the dealership told me that 3 Japanese Engineers had flown in to Houston to update the ECU for all FRS/BRZ's sitting at the port.
They left Houston and visited my dealership the next morning to flash mine and one other car. Then they were heading to another southern dealer.
If you are getting the rough idle and or the CEL that reports an issue with the cam, then this is the fix.

3 weeks, in shop, NJ, a sh*t load of parts replaced on the first attempt to fix the CEL issue, now replacing ECU and expecting to be ready for pick up later today

Got a call from Mark at 1 pm today.
He said: "Talked to Toyota, they are sending a new ECU. No ETA on it's arrival date. Toyota wants us to not release the car back to you for "safety reasons"
I will call you when I get more info."

Service manager just called me and told me the Toyota Engineer (who makes visits to dealerships monthly) was there today and my car came up in discussion.
He told them the fix for my car was replacing the ECU and not the accuator which was on back order

I got the call back from Mark: Only code noted by Mechanic P0019
ECU to be shipped from Cincinnati, ETA 4 to 5 days.

Server writer called me, confirmed that they are going with the ECU replacement instead of tearing up a beautiful motor

Got the FRS back today. So far so good, and all they did was reprogram the ECU.
My service writer told me that as of yesterday, the official fix is to reprogram the ECU......

2013 Subaru BRZ, 1300 miles, 3 Weeks in dealer, replaced the usual mechanical parts, then the ECU.
Fixed now for 2 days lol and no issues yet..

UPDATE: Got my car back last night. They replaced the ECM (same as ECU I am told) and drove it about 50 miles then let me take it home.

Just got update fron Scion rep. He said my ECU will be arriving wedesday.

UPDATE: Sensor replaced but the light came back on, shocking I know. Dealer said new ECU is supposed to arrive on Mondayell,
long story short they have ordered an entirely NEW ECU for my vechicle with the update to install into my frs between the days of sept. 30 and oct. 3.
The resaon they are installing a new ECU is simply due to the fact that the state of louisiana doesnt have any comp.
to be able to do the flash or software update, so i guess this is there quickest fix, even though its the most expensive.

SO far so good. I got mine back on the 19th and have put on over 200 miles with no problems.
All they did was swap the oil control valves and flash the ECU.
Service writer said as of last Tuesday, that was the official Toyota "fix".

the CAR is running like a beauty, they basically flashed my ecu
Read and weep

Update: IT's BAAAAAAAAAAAAAAAAAAAAAAAAAAAAAACK!!!! Got my car "fixed" with about 260 miles on the clock. I've had it back for a couple weeks but yesterday (the same day I went over 1000 miles) the CEL is back on. This f*&^in sucks!!

Well, that's strike 2 for the California Lemon Law.

What fix did they do on your car? ECU reflash/replace, or hardparts replace, or what?

My guess is that it was hard parts.
Anyway, I just found out yesterday that I am getting a new ECU and that the parts my car has been waiting for (for 3 weeks) are not even going to be installed on the car.
