If - IF - there is anything to be gained from pressurization (and I'm pretty confident in this case there isn't), it's got to be, well, pressurized. Which means no drain holes, etc.

I think this falls under the "can't hurt" category of modifications.

I would think the holes are there not as water drains but to break possible suction in the event of lots of water. Think of the duct as a straw with the end in a drink, with no holes in the straw you can suck up fluid. If the straw has holes half way up it doesn't work so well at picking up fluid. Sure the holes may let out cold air or let hot air in but reduced potential to suck up water is worth it. The factory duct doesn't look to have holes but then again the inlet is smaller.

This quote is from the HKS translated sight.

Two foot deep puddles is a bit to literal of an interpretation. If a puddle was deep enough to reach this scoop you would have bigger issues to deal with. Parts like this need to have a large safety margin designed into them. If one person installs this and do hydro lock the motor they could sue. I don't agree with it but thats how it is now a days with product liability.

I seriously doubt that and I'm sure it'll be great fun for the owner that tries. Not only is this product for the time being marketed only for the Japanese domestic market (which means use at your discretion if you're elsewhere) but many times they're labeled for off-road use only or similar as well.

I'm sure the design has a bit of liability reduction built in mind but it sounds more like a marketing feature to ease anxious buyers than anything.
