I think this is the nail in the coffin regardless of what oil or filter was used. Looking at the gear ratio chart posted, not saying this is what happened, it's probable that you are at the top of 5th and going to grab 6th but money shifted into 4th instead. I wonder if there is a delay in the ECU registering gear selection hence the gear read out was 5th instead.

Rather than lawyering up, i will request to review the "black box" data that was retrieved and challenge that. However, i feel this is a extremely slim chance.
The "gear" indication is an ECU calculation. There are no sensors listed in the parts.

The oil filter probably has nothing to do with the failure but it doesn't matter it is an easy out for them.
Who are you going to ask to do a review of the black box? The dealer? They are not going to change their minds and a deeper dive could find even more damning info. Tackling one aspect of this mess isn't going to resolve anything anyway.

Thanks for the clarifications. My initial thought was that the tech's notes were cloudy at best hence clarifying that and gear selector might reveals more beneficial clues but from the sound of things, the only metric in question is 8300rpm. Doesn't matter how you got there but it got there.

Yep. Although the rated redline usually has a significant safety factor built into it over is still over.
The fact that it hit 8300 alone really isn't a death sentence though. It is more how did it hit it? A miss shift that takes you from say 4,000 to 8,3000 in a split second hit with far more force than being near redline and just nudging it over.
The notes totally suck and are almost illegible but in the end they are enough to clinch the denial.

Just to clarify about oil filters which admittedly was confusing.

I finally was able to get the correct filter THROUGH Toyota parts dept..

Toyota part # SU003-08412 (which is Subaru 15208AA170 NOT AA130). Don't want to give these dealers any room for denial. I'm not panicked just trying to be open to learning and being diligent so I can enjoy my experience as much as possible.

It's all we can do.

toyota SU003-08412 has subaru 15208AA130 printed on it. if they gave you an AA170 they grabbed the wrong one off the shelf.

Except he says there was no money shift, and has video of the time of the supposed event to prove it. Maybe we're talking about someone else at this point.
