@Rustyoid, I would appreciate your take on a conversation I had with a dealership sales manager yesterday, who admitted that their dealership cannot place orders for the GR86, they just get what stock Toyota chooses to allocate to them, and can only trade with other dealers to try to meet a customer's specs. When I asked if I could make a deposit over the phone he said I needed to come in and sign a sales contract because Toyota had tightened up ordering rules as dealers having difficulties getting cars they wanted to sell had been submitting phony orders in order to get stock, and now Toyota wants to see real orders before shipping vehicles. Asked under what conditions a deposit would be refundable, he said it would be refunded if they are not able to deliver to me the GR colour/trim/transmission I specify in the order within a mutually agreed upon time frame.

The problem with that of course is that unless you are willing to kiss your deposit goodbye, it ties you to that one dealer when trying to find a car, as you have no way of getting that deposit returned as long as they find a car for you within the time frame specified in the contract. And the rationale the manager gave for this may make sense for other models that can be ordered by the dealership from Toyota, but as the GR86 can't be it makes absolutely no sense at all for that car - whatever orders the dealership has signed with customers have no impact on what 86s are allocated to the dealer and Toyota would presumably have no interest in seeing them. Is this manager trying to pull a fast one on me, or are the conditions he's specified for the deposit being refunded legitimate and SOP?

That is correct that we cannot simply "Order" a GR86. But it is incorrect that we can order other models, it is the EXACT same process for every vehicle. Every "order" entered into the system is actually an allocation request, to be allocated that specific config with the customers name attached. Dealers are given a yearly sales plan. These requests would be allocated against the sales plan numbers. You cannot place additional orders to get more than your sales plan. Obviously SUVs and trucks have a massive sales plan compared to GR models

We are in a similar situation with all models. We want to make sure our vehicles are staying in our market and going to real customers so we do not just take deposits like a free for all.

I've said this before regarding deposits and markup in Canada.

The "sales contract" is only legally binding if there is a VIN number on the contract.

A dealer CANNOT legally keep your deposit in Canada if they did not specify a VIN. At the same time, they can legally change the selling price to whatever they feel, if there was not a VIN on your sales contract.


Dealers often use the non-refundable to keep tire kickers and such away. But it is simply not true.

Bro, when did you place your deposit? I put mine in the other dealer in Vancouver in April, well, I did not actually pay them deposit but I got my name on the list and the money will be due when they get the VIN from the factory. I took my car to my dealer for having maintenance on my daily driver. The sales manager told me there were 17 people ahead of me and they had received averagely ONE allocation per month. So I will have mine in about January 2024 lol.

I know getting on the list in April is kinda messed up, but GR86 was not actually in my plan. I paid the dealer 1000 for reserving a spot for the GR Corolla. I went to the dealer and picked up my new daily driver this April and had a chance to have a conversation with the general manager regarding the gr corolla. I told the general manager that I got my money not the GR corolla and wondered when the car could show up. He got back to me and said the dealer would only get one gr corolla for 2023 and not sure if they could get another one for the rest of production years. He got my 1000 bucks refunded, put my name on the 86 waitlist and promised me to sell at MSRP. (I trust him that he will sell at MSRP as a long time customer, he's a cool guy to talk to)

This is exactly why my dealer said they wanted deposits on 86s and no other models. They are not 86 friendly since they had so many people wasting their time right back to the first FRS they brought in and just got fed up with the whole thing. They wouldn't even stock them past 2016 and gave their allotments away to other dealers.
The problem with the word "order" is that many dealers use that term and it implies that they are getting a specific car made for the customer. Even companies that do send in "Orders" are probably just placing a hold on an allotment car. Nobody is making cars to order. Well not in the 86 price range at any rate.

No - I get that part. Same thing is true in the U.S. The issue I have is handing your car over to the dealer BEFORE he gets an allocation/car. What if he never does? Then he is beholden to the dealer's trade-in price which, if the same thing is true as it is in the U.S. (typically) is A LOT less than you can get from any of the Internet/mass dealers at this time.

In fact, when I did it, even including the amount I would have saved on sales tax did not make up for that difference. Even if he didn't want to put another mile on it, he would be better off (IMHO) leaving it in his garage until his car came in.

Actually, you should have said when you get a new car in Canada don't hand the dealer your Gen 2 as a down payment/deposit. And don't worry - I won't. I won't even do it in the U.S. (at least not before I actually have the new car). Nice try, though!
