If your order and spec goes into the ordering system then it should be built. It's a no brainer! There is no point supplying your dealer anything different.
This reminds me of a Seinfeld episode about taking a booking for a hire car, but not having it available at the time.

When I went to have a look at another Toyota dealership over the weekend, I saw a nice Orange GTS getting ready for delivery to a customer.

The salesman told me that it was being delivered quickly 'as a favour' to someone who is involved with fleet purchasing.

Made me wonder whether they had flogged off some other poor buggers car to sell this one to an important customer. (speculation)

He also told me 'If you ordered through us instead of your dealer, we could have got you the car in a month!'. So I said "Ok, i'll order through you then". Then he said "Oh, just kidding, it will be 10 months."

Ohhhh car salesmen...

Anyone thinking fair trading, chances are you need to report your dealer, not TMCA.

TMCA would only accept orders from dealers on and after a particular date in time. Let us say this was the start of June, when pricing was announced. TMCA would have allocated vehicles to dealers for launch, with limited choice of grade, transmission and colour.

Before this, dealers (as independently owned and operated entities) would have certainly been taking 'deposits' and called them 'orders' ... all the while banking the cash and saving on or earning interest.

Come early June in the above example, when dealers can actually order, dealers could start allocating vehicles to customers. Here is the most likely point of getting screwed over, as all salesman promises may not be possible for the stock controller (who is just trying to make everyone happy).

So now the vehicle is 'delayed' and that is Toyota's (TMCA, TMC, etc.) fault, where there was no buy-in to the contract or promise from anyone but the dealer to you.

You should have known a 'per-order' was not legitimate, as there was no drive-away pricing.

If you waited for pricing, had an agreed delivery month and the had it delayed, this may well be the result of the above happening to the pre-order customers and your order is fallout.

Great work Toyota on attracting new customers!

PS: Have to mention the alternative - Toyota Sci-Fleet Kedron have been very good, if they had stock I would consider buying the car off them. They are unfortunately pretty sure that they can't deliver until very late this year/early next year (I appreciate this rather that telling me porkies) and I believe that if I still want the car by then I'll be able to get it sooner from carsales.
Same for me at this dealership, I was first to pre order in march no car till september / october.............
I am over it , sucking it up, waiting patiently......... ordering parts while I wait.

Without prejudice:

Alright guys, please allow me to respond before you crucify people who have NO CONTROL WHATSOEVER OVER MANUFACTURING OF MOTOR VEHICLES.

OK, we get it - you guys are angry because you put money down in good faith. Speaking for myself I have taken over 30 orders for 86's in good faith and given each ordering client the opportunity to cancel with a full refund if we cannot supply the car within the legal time allowed (30 days after the ESTIMATED DELIVERY DATE). When you purchase a new car in NSW it is your legal right to cancel your order with a full refund if the dealer cannot supply the vehicle to you as ordered within 30 days from the estimated delivery date.

Let's look at the phrase Estimated Delivery Date shall we?

Estimated does not mean guarantee. The reason we have 30 days to have your new car available for delivery from this date is due to any unforeseen circumstance that is outside our control as dealers, including but not limited to, freight delays, bad ocean weather, manufacturing delays, etc.

There is no legal way any NSW new vehicle motor dealer can refuse to refund your deposit after the 30 day period after the estimated delivery date has expired UNLESS you signed the contract in the space provided that waives your right to cancel after the 30 days has expired due to the vehicle either being unusual in nature or comprising options and or accessories that are unusual in nature. If you waived your right to cancel the dealer is within it's right to hold your deposit as long as needed to complete the transaction, i.e. as long as it takes to have the new car available for delivery.

Now for the second part. A new car contract of sale in NSW MUST HAVE AN ESTIMATED DELIVERY DATE. If it does not, my interpretation is that it is not valid and you should be able to cancel the deal and get a full refund. On some of the contracts I have supplied to some clients I have not put an estimated delivery date on them knowing full well that I could lose their business but there is no way in hell i would compromise mine or my employers reputation by doing anything untoward a client in a contract of sale. In other words I've left most of the contracts open to cancellation being unsure as to when Toyota Australia would deliver the new cars to us regardless of the "planned delivery month" stated on the build to order cars, thereby, giving my clients a way out of a crappy situation if they happen to be one of the unfortunate ones whose car is unreasonably delayed, for whatever reason that may be.

Going back to my initial statement in regard to "NO CONTROL WHATSOEVER OVER MANUFACTURING OF MOTOR VEHICLES". As new car motor vehicle dealers we have no control whatsoever of the manufacturing process. When we take an order for a car from a client we "build the car" - what that means is we order the car from the manufacturers representative, in this case Toyota Motors Corporation Australia Limited, and we receive delivery details from them which includes a "planned build date." Let's look at that particular phrase shall we?

"Planned build date" is an ESTIMATION ONLY as this is when the vehicle is planned for build on the production line - not the date in which the vehicle is actually produced. Frequently things change on a production line - particularly one which makes more than 1 type of car. Never having seen the Fuji Heavy Industries manufacturing plant where the Toyota 86 is made I can't comment on specifics, however, most manufacturing plants have the same issues sometime during their life cycle whether that be extended maintenance times or low supply of components required for particular builds, there are a myriad of issues that can effect an assembly line - guess what? These things effect "Planned build dates."

I'm sorry if this is coming across as condescending or patronizing but i'm sick to death of being abused and accused of things that are TOTALLY OUTSIDE OF MY CONTROL as a sales representative. I have done my job correctly and done the very best i can to keep my customers informed in a timely manner and protected my customers as much as possible from being stuck in a contract which is never-ending by giving them escape clauses so they don't get screwed over.

Now, a word on things that are outside TMCA's control. As i don't work for TMCA I cannot comment on specifics, however, there is no way in hell that these guys and gals would deliberately deceive the very people they have been looking after all these years - you, the customers. Guess what? They don't manufacture the car either and it is most likely outside of their control as well.

I'm not looking to blame anyone for the delay in deliveries. Whoever is at fault is irrelevant, what i'm looking for is a solution to this situation. I'm sorry if a bunch of you are butthurt over this and in your situation i most likely would be as well for a little while, unfortunately calling out your dealers for not supplying a vehicle by the estimated delivery date will not make it happen any sooner because all you are doing is shooting the messenger who has no control whatsoever of the vehicle UNTIL IT ARRIVES AT THE DEALERSHIP.

As far as pre-orders are concerned, we are one of the dealers in Sydney, NSW that took pre-orders on the car. It has always been our practice to give cars we received in order of the people that placed pre-orders with us - IN ORDER BASED ON THE DATE THEY MADE THE ORDER WITH US. By the way that means FIRST IN, BEST DRESSED. Please also allow me to state unequivocally that we HAVE NOT AND WILL NOT ALLOW ANY QUEUE JUMPING WITHIN THE ORDERS WE HAVE TAKEN as this is an ingenuous practice. ALL OUR CUSTOMERS HAVE THE RIGHT TO DISCUSS CANCELLATION WITH US AT ANY TIME. And if reasonable grounds are given - or if we have provided for cancellation in special conditions on the contract, we will of course cancel the order with a full refund.

Now, allow me to share with you 2 particular situations that have transpired in the last month and how we handled them - the first is that we received a Tornado Grey GTS in Auto instead of Manual that we already had an order for. We tried every way possible to swap that car for a manual one with another dealer so we could supply the GTS in manual to my first pre-order client. We were unfortunately unsuccessful, so we then offered the vehicle for sale and sold it to dangerfield.

The 2nd situation we had is we got lucky and picked up another GTS Auto one for earlier than expected delivery but instead of just selling it to make more money which is our right to do so whether you like it or not - we didn't sell it, we instead gave it to another pre-ordered client to bring her delivery forward by a month.

Those are 2 examples to prove we kept our word to our clients that A) we will attempt to stock swap cars to fulfill our pre-orders first if we didn't get the cars as expected and that B) we kept the availability based on when our clients pre-ordered.

Another thing too, when we accepted pre-orders from clients - WE ORDERED THE CARS IMMEDIATELY. WE DID NOT WAIT UNTIL THE 4th of JUNE NOR DID WE WAIT UNTIL OFFICIAL RELEASE ON THE 18th of JUNE. As is normal we received planned production dates on the build sheets. Unfortunately the planned production dates shifted by one month extra -

AND THEY HAVE DONE SO AGAIN.

THIS IS A MESSAGE TO ALL CLIENTS WHO HAVE ORDERED A GTS FROM WARREN TOYOTA - THE PLANNED BUILD PRODUCTION DATES HAVE SHIFTED AGAIN and BEEN EXTENDED BY AN ADDITIONAL MONTH.

All we can do is apologize on behalf of the manufacturer and ask you to wait patiently for your new vehicles to arrive - there is no preferential treatment to any individual customer, regardless of price at Warren Toyota. I have already turned down more than one offer to let someone queue jump as i believe it is an unfair practice and not in the spirit of Toyota.

In addition, we are aware of our legal right to charge what we see fit for dealer delivery fees, however, we are an honorable and reasonable dealership and have kept our dealer delivery fee capped at $1,895.00 inclusive of GST as we don't believe at this time that it is conducive to good business practice to gouge more money out of the 86 deals - it would only exacerbate the situation even more.

I've mentioned this in other threads before but allow me to share with you again that there is no logical reason any dealership would want to delay delivery of your new car because we don't get paid until you pay for your car. All we do is take a deposit on orders to secure a car for you - it is possible to take new car orders without deposits but we have decided not to on 86's which is our right as a dealer. It is your right as a prospective client to order or not order a new car - we cannot and have not forced anyone to buy a new car. Purchase or do not purchase, that is your choice as a consumer. If you choose to purchase a new car through us we will do our very best to supply you with your chosen vehicle as quickly as possible. That's the best we can do.

As for people who may wish to contact The Department of Fair Trading in relation to any new car contract you have with us, we would ask that you contact us first to discuss the situation so we can see if there is some kind of remedy or so we can offer you a refund if necessary, if however, you feel we have not done the right thing by you, please contact them by all means, they're number in NSW is: 13 32 20.
