Just went to the dealer and got back to my parents place with a newer Impreza loaner (bleh).

So they had the car all day and only managed to, supposedly, check the fuel lines which apparently had ZERO problems (sorry @Tcoat ). They couldn’t do the leak down test (I forget the proper name for it) or anything else supposedly, so they have to keep the car overnight and then tomorrow they’ll continue testing.

I did find this earlier, and I know YMMV as with anything else but worst-case scenario I’ll at least show it to them and see if I can use it as a bargaining chip: http://www.semasan.com/semaga/images/warranty_ftc.pdf

Guess we’ll see.

But, maybe if they confirmed the fuel lines aren’t the issue then they’ll ignore it as a possible cause and get me back under warranty. That’s my hope anyway. Gotta be optimistic!

Didn't say it was the kit just that it would be interesting if it was.
Not sure how you think that document helps your case? Unless I missed something Your issue wasn't who did the routine maintenance.

Haha was just kidding that I’m glad it wasn’t necessarily that.

Not the maintenance bit but it does touch on more than that. It mentions aftermarket parts and needing the dealer to provide proof that a necessary repair is related to that to void warranty.

It’s what we already know but dealers will try to squirm out of. Since we were talking earlier about how the issue likely isn’t related to the flex fuel kit at all despite them saying it probably was / was preventing them from doing further diagnostics without me saying I would pay because of it.

I think you will find that the reference to "aftermarket" parts refers to the same part that just isn't OEM. A tune, header, FF, or other mods may be aftermarket but they are not the "aftermarket" parts that the law covers. Worth a shot though.
Everybody jumped all over the dealer suspecting the kit when in reality it is indeed one of the first things they needed to eliminate and look at so suspecting it is totally reasonable not an indication they are trying to deny you anything. They are not responsible for tying to fix a modded car under warranty so the first step is and should be to get it back to stock and see how it works.

Great news today. The hospital is paying for all the expenses associated with my trip to the emergency room. That was a $5k stress hanging over my head. I'm glad they said it was their doctors fault and agreed to pay. I didn't have to make a fuss.

Yep. I understand what you’re saying.

Doing the physical checks and then onboard ECU diagnostics and whatnot is definitely a reasonable order to investigate.
