Pretty sure there's going to be frame damage. Is this your first major accident? I would recommend getting a lawyer and having them sort everything out. You won't need to pay a cent out f your pocket if youre not at fault.

I am calling my Lawyer on Monday. My main concern is what I owe on the car. I'm positive there will be a few grand that they payout won't cover. I'm also not sure if I have GAP coverage and honestly up until this happened I had no recollection of it, however I do think my Credit union rep when I bought the car mentioned it and told me to get it, hope I'm not wrong.

However I've been told a few times now that because she is at fault, and this would not be an issue otherwise that they should be paying the remaining balance regardless. Hence what I'm going to be using my lawyer for.

Not to mention I got pretty banged up.

Why not use your insurance companies lawyer? That's part of what you pay for. "Hey, insurance dude! This is what happened, here's the report, call me when the clown that hit me and her insurance company pay off the total balance of my car. Feel free to mention the trouble I'm having walking if you need to."

Well, my insurance company wanted to total it. Her insurance company wants to fix it even with the estimated 15k worth of damage (without having even torn into it yet)

I could have nationwide total my car, pay it off and go after them. HOWEVER.. the shop is quite reputable and wants to try and fix it.

I'm obviously not an insurance or repair expert but i can't believe they want to try and repair more than half the MSRP in damage....even if they did repair it I would be really skeptical that it was properly fixed after the seeing the damage in the picture.

Thats my concern, however should it not be able to be brought back to 100% spec, well then it gets written off anyways.

Can't vouch for the US but up here the rule of thumb the companies use is up to 75% of the value gets fixed.
