After having similar looking (if not worse) damage to my car, I can almost guarantee you that it's not a write off. New rear bumper, probably replace the quarter panel, some suspension work and your done. $10k maybe?

We don't have diminished value claim (with insurance) in Canada. He would have to sue the person directly and try to recover lost value that way. I spoke to a few lawyers, and they basically said not to bother because of the low success rate.

If she's not staring at her dog or the opposite direction it's just plain accident. One of the downside about small cars like the 86, is we're sitting ducks to other bigger cars such as SUV's and trucks.

In New York you can ONLY sue for medical damages above what insurance covers. The court won't even allow a claim to be filed for anything else.

Nearly every day on my commute I have to lay into the horn or stand on the brakes to keep from getting squashed. NYC is the land of big vehicles being driven by drivers with questionable credentials. The most popular vehicles being used for livery cars are Suburbans/Escalades/Yukon XL and they really don't give a hoot about small cars, they literally just take them out and keep going. Many of them have huge bumper guards so there is very little chance of them sustaining significant damage unless they really hit something hard.
