Ive seen settlements of hundreds of thousands of dollars for stupid stuff. $40,000 is being nice for something like this.
He didn't die.. That's you suing the guy that ran the stop sign because... You could've died.. Getting his loan paid off all well and good.. Asking for a free car.. Nothing wrong with that.. Demanding a free car and suing if you don't get it.. Yah.. I believe something is wrong with that..

Something can always happen.. But it didn't.. And to me, your mind set is what's wrong.. People sue for stupid reasons because of your mind set.. Nothing bad happened except a burnt car..

Like in your example.. You believe it's stupid.. But google gave said person a route that didn't have a sidewalk and a car could've hit them and he couldve died.. See all stupid.. They didn't die... No one was hurt.. The car didn't explode..

I mean there wasn't a sign there at the escalator.. The guy could've fell and died.. If the dude came out with burns and barely escaped with his life.. Maybe I'd feel different.. I feel for the guy.. To watch his car burn would suck.. I lost a house to a fire.. Not the same but it still sucked to watch everything burn up..

I believe the dealership will do the right thing.

Keep us informed. Best of luck.

Sure, he can sue them to replace his car if there was negligence on their part (and based on the information provided, this is likely the case), however expecting reimbursement above and beyond that is unreasonable.

Okay, I understand your point now. But I never read OP saying he wanted MORE then what he lost in the fire, unless I missed something.

No worries. I was responding to the other posters that were suggesting the dealer should pay off his current car loan AND give him a new car on top of it.

I understand your point that you can't sue for something that "could" have happened... All I'm saying is that I believe he deserves something. In my mind this is gross negligence that could have ended up with a much more unfortunate result. The reason I brought up the escalator sign scenario is to show how people can sue for this sort of thing. Unlike the escalator lawsuit, this wouldn't be a "this is what wrong with america sort of lawsuit" because the person that sued over a sign not being put up could have easily taken the stairs instead.

Sorry for the late update, but the dealership's insurance company paid for the car back in March and then I started looking again for another BRZ and then finally found one and put a deposit down for it and picked it up on 3/21. Just want to thank everyone here for their input on this situation.
