I would sue the idiot who failed to yield for damages to both yourself and your car. This guy needs to be held accountable. But then again, I'm no legal attorney.

you would want it totaled. With a damage that intensive, the car won't be the same after repairs. Like everyone said, just be glad that you didn't sustain any major injury. Cars can be replaced.

I felt the same way at that time too. Luckily you're not at fault. Insurance will take care of you and won't screw you over since it's a very new car. You'll survive and gain valuable experience from this.

thanks, from talking to a lot of people and based on the damage, it seems like it would be better to have the car be declared a total loss.
this couldn't have come at a worst time, winter is approaching and we just got our first snow of the year bleh.

i guess i'll have some winter tires/wheels/tpms(with very low miles, used for less than half a winter) and a stock axleback exhaust for sale shortly if it is deemed a total loss

how long does it normally take for an insurance company to determine total loss or repairable?

That's what insurance is for. A lawsuit would take years, potentially, whereas an insurance payment is easier and faster.

...you were serious about that? i thought you were joking in the thread title. i'm no adjuster, but i'd bet real money they're going to total it. i would seriously be shocked if they repair. half your front's gone.

Glad you're okay. Man, I've never seen an accident where the front suspension was just wiped off clean like that...


When I was rear ended and my car was totaled, it took my insurance (State Farm) less than 2 days to declare it totaled. I was hit on a Thursday morning and by Friday afternoon, the adjuster had already looked at it and declared it totaled. I got the title transfer paper work the following Tuesday. Because of my dillydallying I got my check a week later.

Then I went down to the Scion dealer and bought my FR-S the following weekend (a little over two weeks after the accident)!

an update....

well my insurance provider investigated and found the other party to have insurance which is a relief

the total loss adjuster inspected my vehicle today and will have the results tomorrow by end of day... honestly i do not feel safe getting back into a vehicle with that amount of damage and feel extremely uneasy about hidden damage and things that may come up in the future if they deem it repairable, i really hope they make the proper assessment in it being a total loss
