Haha! I didn't order in a Group Buy. I ordered off of the website after the Group Buy had already been closed.

"1. You can't get your product until it reaches critical mass and who knows how long that will take."

So basically you're saying that it's okay for him to take order after order and keep collecting money when he has not had a product to ship since March?

I guess I can just start a Group Buy for some BRZs. Buy one now for only $100 and when I have enough people buy I'll ship out your BRZ. Oh, but there's no time frame or set number of buyers before I ship out your BRZ. We'll just see how much money I get first...

"2. You put the money up front with no guarantees that it'll go through."

That's not true when I have a receipt for the order. It's not like people are giving him money in hopes of getting a product. There are no IF's about it. There is a product for sale. The reason for a Group Buy is to get a discounted price, not to invest our money freely into someone with hopes of them producing a successful product. No one is gambling their money with a Group Buy. It's a purchase through a business. What business do you know that does not refund your money after you purchase a product that they cannot provide?

I hope the next time you go to McDonalds you pay for your food and then they tell you, "Sorry, we're having a problem making food right now. No refunds."

I want to chime in -- 70 dollars is a drop in the bucket for some people. I can agree, but money is money. No matter what, you're out an absolute 70+ dollars.

You can only say that "YOU" won't stress about 70 bucks, but don't downplay the amount of money dropped into this investment because it's still an absolute amount. It's not so relative. You earned this money... Anyway, point being -- If you need your cash back based on an undeliverable products, by all means I think go through the bank. I think in this situation the seller isn't the complete asshole that everyone makes him out to be. There was just a blip in the schedule (being as impartial as possible). There is some update problems, but I rather have a seller that gives us a bunch of updates that mentions the same than none. Because I can at least see that then the manufacturer maybe at fault and maybe then I wouldn't have "pulled out" heh heh.

What if I walk into McDonald's and they say if 20 people agree to buy a big mac, it'll only cost $1.00. But, we can't make the burgers until we get $20.00 because then we have to use the $20.00 to buy $15.00 worth of meat. McDonald's then goes to the meat distributor and orders $15.00 worth of meat, pays them. Then the meat manufacturers says that the meat is tainted with mad cow and they won't have new meat for 3 months but you already ordered the meat so no refunds.

Now McDonald's only has $5.00 dollars and 20 people that want their dollar back. What does McDonald do? What would you do?

I would call my bank and file a claim for the $1.00 and then go to Burger King or Wendy's, maybe white castle if I'm desperate.

seems to be a good solution but that's if you're only thinking of your self.

what others dont realize is, every time you fail a claim, i get hit with a $35 fine.

(setting 20 units as an example)

$35 x 20 = $700
Profit Margin on each unit = $10
Profit on GB = $200
Total lost = $500

more fines = more problems... does not really help the current situation.

either way the products will be delivered as promised

No one is "OUT" any money, we will receive the product when it arrives, simple as that.

We actually are OUT of the money being that it has left OUT of our bank accounts, genius.

Just my $0.02. I did not participate in this GB, but I would like to just point out a few facts I have witnessed.

1. 86_ZN6, better customer service may have alleviated the tension that so many of these people are feeling. Most of us know what it feels like to be jerked around (not saying that you are doing this), and if a situation feels reminiscent of that, we might react in the same way. Sometimes it is better to go on the offensive if being defensive doesn't seem to be working for us. Again, I don't know what happened between you and your clients, but there are ways of turning things around in your favor.

That being said, everyone else should please remember that:

2. Chargebacks, and encouraging them, as @86_ZN6 mentioned above, can really drive merchants out of business and cause them to have serious financial issues. I used to work for a credit processing company and chargebacks are serious issues. Visa/MC can withdraw their rights to process their cards if a vendor has too many on their record (I don't know how many did it now, but it seems like a big hit), which can effectively destroy a business in short order. I don't know how many of you are small business owners (I am), but sometimes unexpected things happen and getting angry and taking retribution often hurts us all. What happened here is not an example of a "Quality error", but more of a "Buyer's remorse" situation, or what they call "friendly fraud". Look it up!

This is from the wiki entry:

"Friendly fraud is a very real problem to businesses and merchants, and LexisNexis reported that merchants are paying $2.33 for every $1 lost in fraudulent transactions."

I have seen a lot of good merchants lose their business in situations exactly like this. 86_ZN6 may not be a bad merchant, he may just be having issues. But, as always, communication is the key here. I have lost customers not because of the quality of my work, but sometimes because I cannot respond to them fast enough. That is just life, we are not all special, we are not all pretty little snowflakes and sometimes get caught up in the traffic jam of life. The best way to navigate is to be respectful and calm. On both sides of the situation.

And also, go get a stiff drink!

This thread sure made a sour turn...
Well it doesn't matter. It's approaching the end of the month, and @86_ZN6 mentioned that he'd be sending out those fins to us around the end of the month. I still have my hopes up that we'd get a tracking number or a delivery of confirmation within these next few days.
