You should get the deposit back anyways. I was put in the same situation by DVN when I decided to cancel my FRS order (after I found a BRZ on the lot elsewhere), and then they called me a few days later to say they were refunding my deposit.

How many KM was on it, wondering if this is the car the dealer called me about saying they got one coming sooner than they thought when my original date is end of April. Don't really want it until April ish though, when it's nicer out.

Really sorry about your grandad, sounds he cared a lot for you and he wished for you to have the car. Gotta appreciate them when you still have them, parents too.

However, I am sure you realize the only thing that entitles you to a refund in this case is the terms of the sale agreement or possibly Ontario law.

Frankly I am surprised they dont want to do the refund. Especially if they can easily resell the car. It's just good PR. On the other hand if it sits a month or two they incur interest carrying charges.

Weitzes told me my deposit was refundable but that was at the very beginning when there were all kinds of people to take mine if I passed.

There is no way I would purposefully enter a contract with a dealer that won't refund a deposit on a car after the death of one of the buyers. More especially a car that they will clearly have no problem selling. They are just money hungry. Shame on them.

Sorry to say, but trying to break the terms of a contract on the grounds of sympathy is not common business practice. In fact, some people would resort to lying about a death just to obtain consideration not already available.

They should refund the deposit on the grounds that they incurred no loss with the cancellation of the order, assuming they sell the car to the next person very quickly. In 1990 I used to take $500 refundable deposits for the Miatas. If one guy backed out, the next guy grabbed it. Maybe not in the winter though.

So you purchased the car before it actually was received? Deposits can be refunded, unless you signed a contract of course.

if it's just a deposit then can you just talk to the sales manager and get the money back? I mean after all it's late by 2 months.
HOWEVER, if you signed a financing plan then that's a different story.

I signed a purchase agreement and left a $500 deposit, negotiated financing accessories, warranty the works and still got my deposit back.

Sorry; I didn't mean to infer that the death in the family would be cause for a refund, just that it is another indication of a dealership that is handling a situation poorly. They know the car will sell quickly, they should refund it no questions asked.
