It's based on OBD so if you remove the header cat, there will be a CEL from the O2 sensor. You can tune the car in such a way that this goes away and throws a "not ready" signal, which in VA you are allowed 1 and can still pass the test. I think this will be the case for MD but I can't verify.

Additionally, as long as you don't remove the front pipe cat, you'll likely pass a visual inspection since the header cat is hidden under a skid plate. Most people aren't going to bother lifting the car and removing that or they won't even know there should be a second cat there.

I would assume you'll probably fail an emissions sniffer test like the VA rapidpass ones.
