It's going to depend entirely on the type of testing. It would fail a visual check, but then, so would any exhaust system that replaces either of the cats, in the header and in the front pipe. If you keep the cat in the front pipe, either the stock or a quality high-flow cat, it should pass a sniffer test as long as it's tuned properly.
If it's similar to Washington State, and a lot of other areas, you simply have to pass OBD-II testing. They will stick an OBD-II cable in, check for DTC codes, and if doesn't find any, you pass.
