If you are going over 35, it doesnt matter what kind of bar you have. If under 35, either you werent paying attention or he wanted to get hit.
Also, I guess people shouldnt be lowering or raisng their vehicles either since that changes the impact point.... guess more lawyers to find blame. Dont get me started on motorcycles that dont even have bumpers.....

And depending on the state you'd STILL be at fault, before the investigation even started. There are plenty of states where hitting a pedestrian, even when not in a marked crosswalk, is the driver's fault by law.
