I understand your point that you can't sue for something that "could" have happened... All I'm saying is that I believe he deserves something. In my mind this is gross negligence that could have ended up with a much more unfortunate result. The reason I brought up the escalator sign scenario is to show how people can sue for this sort of thing. Unlike the escalator lawsuit, this wouldn't be a "this is what wrong with america sort of lawsuit" because the person that sued over a sign not being put up could have easily taken the stairs instead.
