It's very rare to see a diesel putting out black smoke[unburnt fuel] these days but when they do it's deadly for anyone else in that area. Diesel is a known carcinogen. They would get pulled over and taken off the road pretty fast here.
Modern diesels[I have one] run very clean and quiet, most without a hint of anything from the exhaust. It doesn't smell quite as sweet as the 86 in the garage but it's certainly not obnoxious.
It also has a catalytic converter fitted just after the turbo.
Any cop should be capable of picking up the stink when they follow your car without a cat and should pull it over and take it off the road until it's fixed.
I hate negative emission controls that give small short term savings in exchange for higher fuel consumption, shorter engine life and rapid loss of efficiency. Thinking diesel EGR that blocks the inlet manifold.[not mine]
However catalytic converters have transformed the air we breath while driving and are simple, long lasting and have minimal effect on efficiency.
