There is always 1 driver's who's at fault for lack of attention/careless driving...he's lucky he was the only one involved.
In my case I learned through this process that any incident with over $1,500 of damage(s) has to be reported. As my incident was estimated to be over by the body shop, they were required to report it and so was I which is how I got my insurance provider involved. So yeah, you're correct.
