He's going to pay in the future because rate will go up. It doesn't matter how you slice it, if he has collision coverage they have to cover it.

Do you know how many time people go off the roads in snowy condition/aqua planning, and have to get their insurance to cover the damage? Should have they been there in the first place? Going too fast? Careless? The lines between accident and stupidity can sometime be thin. And what is a REAL accident? There is always 1 driver's who's at fault for lack of attention/careless driving...he's lucky he was the only one involved.
