In general, MM act applies if replacement parts are done to OEM spec. If not - it does not apply.

What aftermarket parts are OEM spec, why would you replace them then?
Also I would think that would be a hard argument to make. How do they prove I did not have my coils on the softest setting making it more shock absorbent than OEM.
