Yup. The Feds don't enforce those laws at all - the FBI aren't running around pulling people over to check they have proper exhaust. They have, uh, "better" things to do.

And the local police don't really care in the slightest what Federal law says, generally. Their job is to enforce local laws. If there's no local law against it and they want to be jerks, sure, they could cause trouble but it's probably a lot of paperwork to try to get the Feds involved to actually make the charges go anywhere.

So the net result is that (like most laws regarding marijuana) local law is the only law that gets enforced. If there's no local law, it's effectively legal.
