There is just as much chance of a Subaru dealer denying for the exact same reasons. It isn’t just a Toyota thing.
Like the recall failures there were more dealers that fixed it than didn’t but some just refused.
For the money involved it just may be worth talking to a lawyer. Usually first consultation is free.
