Actually we haven't gotten past that. Most states with helmet laws are constantly fighting the anti-helmet, live free, crash, then die folks.
I personally have never ridden without a helmet, even if just moving a motorcycle around a parking lot, but there's a large contingent of riders that feel differently.
Same with seat belts. I've never not worn one, even before it was the law.
As the Bell helmet ads used to say "If you have a $10 head, wear a $10 helmet". I'll let you figure out what that says about someone that doesn't want to wear one.
Now that said, I'm a little conflicted on whether it should be mandated by law.
