yes, bad example, but not far fetched.
Customer tries to blame Toyota/Subaru for not making a safe car or ESC that would save them from the situation to only then find out the customer (other driver) turned the system off XX days in the past, never turned it back on and realizes it's their fault, not Toyota/Subaru.
throw injury or death into this situation and it becomes really messy.
with a system that resets/defaults to always on when the car is started is there for the driver's safety and in some ways absolve toyota/Subaru from fault as the driver has to make a conscious effort to turn the system off.
If you're not one for safety systems, the Carrera GT is out there.

it is pretty obvious when you see the TC/VSC lights come up next to the tach so bad example or not, you're pandering to the PC/snowflake generation...regardless, holding the TC button doesn't completely turn off your nannies anyways. At the end of the day, the driver still has to initiate shutting it off..the fact that there are cars out there that allow some settings to be retained after a vehicle is restarted should be evidence enough. If I forgot I left my stick in a gear when I start my car up and if that caused me to crash, can I sue Toyota for not making it "more" obvious?
