yes, bad example, but not far fetched.
Customer tries to blame Toyota/Subaru for not making a safe car or ESC that would save them from the situation to only then find out the customer (other driver) turned the system off XX days in the past, never turned it back on and realizes it's their fault, not Toyota/Subaru.
throw injury or death into this situation and it becomes really messy.
with a system that resets/defaults to always on when the car is started is there for the driver's safety and in some ways absolve toyota/Subaru from fault as the driver has to make a conscious effort to turn the system off.
