You are partially correct. The international standards say the speedo can never show below actual speed when tested, but can show as much as 110% of actual speed. So, in theory, it would never cause you to speed.
Now, that is with standard tires, etc, etc.
I think if you go have it tested and it shows it was inaccurate, then you can use that in court, but its very unlikely it will be in your favor.
