Be sure to request a 'diminished value' claim/appraisal from your insurance. Since the car no longer has a clean title, your insurance should pay you the the difference in average sale price between a clean title and salvaged title vehicle.

If your appraiser does deem the car to be a total loss, it may be worth having a lawyer draft a letter saying they will be representing you if a fair settlement amount is not reached in a timely manner. My car was totaled a while back, and they finally offered what I considered to be a fair settlement amount within 24 hours of receiving a letter from my traffic lawyer. Just to brag, the offer I ultimately accepted was their 4th offer in 3 weeks, and was 40% more than their initial settlement offer .
