Hard to tell in the picture but you may very well be able to get that fixed by a good PDR guy for well under the $500 deductible.
Police do not actually determine fault inside adjusters and field adjusters will if there is a question of liability, a police report isn't required in an accident. But with this it is basically a case of no fault and both would probably have to go through their own insurance, cause honestly he could have crossed and hit her.
